Critically analyse the main ways through which children are able to participate in family law proceedings within Australia and have a voice in relation to judicial decisions made about their future. In doing so, reflect upon and analyse proposals 7-8, 7-9 and 7-10 of the ALRC Review of the Family Law System Discussion Paper (October 2018) and recommendation 44 of the ALRC Report 135 Family Law for the Future – An Inquiry into the Family Law System – Final Report (April 2019). In your answer, you should canvas the current position in Australian family law, drawing on case law, legislative provisions, as well as secondary sources. If appropriate, you should also look at how other jurisdictions deal with the participation of children in family law proceedings, and make any recommendations that can help improve upon current practices in Australia.
